Welcome to DailyTube (the "App","we" or "us"), a local media player developed by Leonie Becker (the "Developer").
These Terms of Service (the "Terms") constitute a legal and binding agreement between you ("User", "you" or "your") and the Developer, governing your access to and use of the App and all related services, features, and content provided therein (collectively, the "Services").
By downloading, installing, accessing, or using the App, You consent, agree and undertake to abide, be bound by and adhere to the Terms and if You do not agree to these Terms, You should not access or use the Service.

By using the App, you represent and warrant that you are at least 16 years of age (or the legal age of majority in your jurisdiction, whichever is higher). DailyTube is a local media player application designed to play locally stored media files on your device. The App provides the following core functionality:
DailyTube does not require or provide any user account registration, login, or profile system. You may use all available features of the App without creating an account or providing any personal identification information.
DailyTube does not offer any in-app purchases, paid subscriptions, or premium features. All features of the App are available free of charge.
DailyTube does not support or enable the creation, uploading, sharing, or distribution of user-generated content. All media files accessed through the App are stored and remain exclusively on your local device. The Developer does not host, access, or moderate any of your local media files.
Subject to your compliance with these Terms and all applicable laws and regulations, we grant you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the App solely for your personal, non-commercial purposes on a device that you own or control.
We reserve the right at all times to remove or disable access to any part of the App without liability to You. You agree that you shall not, and shall not attempt to:
All right, title, and interest in and to the App, including but not limited to its software, design, graphics, user interface, logos, trademarks, features, and all intellectual property rights therein (collectively, “Intellectual Property”), are and shall remain the exclusive property of the Developer and its licensors, as applicable.
These Terms do not grant you any ownership rights in the App or its Intellectual Property. Nothing in these Terms constitutes a sale or transfer of any intellectual property rights from the Developer to you. All rights not expressly granted herein are reserved by the Developer.
The information that You provide to us is subject to our Privacy Policy, governs our collection and use of Your information. You understand that through Your use of the Services You expressly consent to the collection and use (as set forth in the Privacy Policy) of this information.
The App integrates certain third-party software development kits (SDKs) to provide analytics, advertising, and attribution services. For detailed information regarding the data collection and processing practices of these third-party SDKs, please refer to our Privacy Policy. You acknowledge and agree that the Developer is not responsible for the availability, accuracy, or practices of any third-party services, and your use of such services is at your own risk.
To provide its core functionality, the App requires access to the media files stored locally on your device. The App will request your permission to read local media content. The App does not access, collect, or transmit any media files to external servers. You may manage or revoke this permission at any time through your device settings; however, doing so may affect the App’s ability to function as intended.
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Any revised Terms will take effect immediately upon being posted within the App or on our designated webpage. The "Last Updated" date at the top of these Terms will reflect the most recent version.
We may make reasonable efforts to notify you of material changes; however, it is your responsibility to periodically review these Terms to stay informed of any updates. Your continued use of the App following the posting of any changes constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must discontinue use of the App immediately.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

The developer does not control, endorse, or assume responsibility for any media content you choose to play through the app. You are solely responsible for ensuring that you have the lawful right to access and play such content.
Your use of the app and any media content accessed thereby is at your sole risk. You will be solely responsible for any damage to your device or loss of data that results from such use.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

We reserve the right, at our sole discretion, to suspend or terminate your access to all or part of the App at any time, with or without notice, for any reason.
Upon termination of your access, the license granted to you under these Terms shall immediately cease, and you must delete or destroy all copies of the App in your possession. The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7 (Intellectual Property Rights), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification).
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid. If such modification is not possible, the provision shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect.
The failure of the Developer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by the Developer.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of the App and supersede all prior or contemporaneous agreement relating to the App.
